Terms of Service

These Terms of Service ("Terms") govern your use of the Nightside mobile application and the nightsideapp.life website (together, the "Service"), operated by Nightside ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Nightside is — and isn't

Nightside is an entertainment app that lets you chat and hold voice calls with fictional AI companions. Every companion is generated by artificial intelligence. No companion is a real person, and nothing a companion says should be treated as fact, advice, or the words of a human being.

Nightside is not a medical, mental-health, or counselling service, and it is not a substitute for human relationships or professional care. If you are in crisis, please contact the resources listed on our Support page — in the US, call or text 988.

2. Eligibility — adults only

You must be at least 18 years old (or the age of majority where you live, if higher) to use Nightside. By using the Service you represent that you meet this requirement. We may suspend or terminate accounts we reasonably believe belong to minors.

3. Your account

• You can sign up with Apple or with an email address and password. Keep your credentials secure; you are responsible for activity on your account.
• You may delete your account at any time in the app (Profile → Delete account). Deletion is permanent and removes your conversations, memories, profile, and remaining balance.
• We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to interfere with its operation.

4. Purchases, diamonds, and subscriptions

• All purchases are processed by Apple through the App Store. We never see or store your payment details.
• Diamonds are a virtual currency used inside Nightside (for example, to send gifts). Diamonds have no real-world monetary value, cannot be exchanged for cash, are non-transferable, and do not expire.
• Nightside Pro is an auto-renewing subscription that unlocks features such as voice calls and unlimited messaging. It renews until cancelled in your Apple ID settings at least 24 hours before the end of the current period.
• Refunds are handled by Apple under App Store policies. Except where required by law, diamonds and used subscription periods are not refundable by us.
• Prices, features, free allowances, and the diamond economy may change. Where changes materially reduce something you have already paid for, we will take reasonable steps to be fair.
• If your account is deleted (by you) or terminated for violating these Terms, remaining diamonds are forfeited.

5. Acceptable use

You agree not to:

• use the Service if you are under 18, or make it available to anyone under 18;
• attempt to generate unlawful content, including any content sexualising minors — this results in immediate termination and, where appropriate, a report to authorities;
• harass, defame, or violate the rights of others, or use the Service to send spam;
• reverse-engineer, scrape, probe, or disrupt the Service, bypass paywalls or rate limits, or resell access;
• upload malicious code or use the Service to develop a competing dataset or model.

6. AI-generated content

• Companion responses are generated by machine-learning models and may be inaccurate, inconsistent, or occasionally inappropriate despite our safeguards. Use judgment; do not rely on them.
• Companions are designed to keep conversations flirty rather than sexually explicit, and to decline harmful requests.
• You retain rights in the messages you write. You grant us a licence to process your messages as needed to operate the Service (for example, sending them to our AI providers to generate replies, and creating the companion's "memory" of you).
• Companion characters, names, personalities, artwork, and the Service itself are our intellectual property or that of our licensors.

7. Availability

We work to keep Nightside available but do not promise uninterrupted service. Features may change, be placed in maintenance, or be withdrawn. We are not liable for outages of the App Store, our infrastructure providers, or our AI providers.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI RESPONSES WILL BE ACCURATE, APPROPRIATE, OR MEET YOUR EXPECTATIONS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHTSIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) USD 50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnity

You will indemnify and hold us harmless from claims arising out of your breach of these Terms or your misuse of the Service.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged in the app or on this page with a new "Last updated" date. Continuing to use the Service after changes take effect means you accept them.
